Scone Court Report: May 2018
The following matters were heard in the Scone local court:
ALLEN, John, a 33 year old from Scone plead guilty to a charge of drive with high range prescribed concentration of alcohol. Mr Allen is alleged to have returned a reading of 0.180 during a random breath test on March 17 on Satur Road, Scone after drinking five schooners at the Thoroughbred Hotel in Scone. A presentence report has been ordered and the matter was adjourned to July 19.
ANDERSON, Louise Marie, a 41 year old from Muswellbrook appeared on charges of Breach of a section 12 bond by failure to accept supervision. Ms Anderson was ordered to keep attending medical treatment and to return to court after the birth of her child with the matter being adjourned to August 23.
BAILEY, Jamie Daniel, a 33 year old from Kurri Kurri had a charge of driver use mobile phone when not permitted. The offence occurred on November 29 on the New England Highway in Scone. Mr Bailey was convicted in his absence and fined $330.
BARNES, Adam John, a 45 year old from Narromine failed to appear in court on three charges of possess prohibited drug and one count of custody of knife in a public place. The offence occurred on September 28 in Cassilis. Police noticed a Holden sedan parked in a rest area approximately one kilometer east of Cassilis on the Golden Highway. When they approached the vehicle to speak to the occupants they noted a strong smell of cannabis and conducted a search of the vehicle. Police found 3.4 grams of cannabis, MS Contin (morphine) 5mg containing 18 tablets and a sheet of MS Contin 10mg containing 10 tablets, Endone 5mg containing three tablets and a knife approximately 15 centimetres long. He was convicted and sentencing was set down for June 21 with Mr Barnes to attend or a warrant will be issued for his arrest.
BLACKADDER, Taylah, a 20 year old from Merriwa appealed a decision by the Roads and Maritime Services for a three month licence suspension. The appeal was dismissed and the suspension was varied to one day starting from May 25.
CHAPPLE, Mathew David, a 38 year old from Scone had one charge of behave in offensive manner in/near public place/school in Aberdeen on December 8 where it was alleged he was urinating. At approximately 7pm a mini bus on which Mr Chapple’s was travelling broke down approximately one kilometre north of Aberdeen on the New England Highway at the time of the offence. The Magistrate agreed while the offence had occurred it was understandable due to lack of access to a toilet. Mr Chapple was given a bond to be of good behavior for 12 months and the fine of $500 was dropped.
COOPER, Mathew Peter, a 38 year old from Murrurundi failed to appear on a charge of drive motor vehicle during disqualification at Weston on December 28 last year. Mr Cooper was convicted and a warrant issued for his arrest.
COX, Dalton Henry, a 20 year old from Scone had a charge of drive vehicle, illicit drug present in blood. Mr Cox is alleged to have tested positively to Methylamphetamine and Delta-9-tetrahydrocannabinol on February 7 in the Coles Supermarket in Scone. The matter was adjourned until June 21 pending legal advice.
CRAIG, Nathan Thomas James, a 35 year old from Claymore had a charge of drive behind other vehicle too closely to stop safely. The alleged offence occurred on the New England Highway in Wingen on January 23. The matter was adjourned until June 22.
CROFT, Paul Aaron, a 42 year old from Carey Bay had a charge of drive, licence suspended under section 66 of the fines act – second offence, which is alleged to have occurred in Scone on March 23. The matter was adjourned until June 21.
DARCY, David John, a 46 year old from Murrurundi had a charge of drive across dividing lines to do U-turn in motor vehicle in Murrurundi on December 29. Mr Darcy had requested the footage of the in car video which was not provided. The matter was adjourned until June 21.
DAVIDSON, Christopher Gordon, a 33 year old from Blacksmiths had a charge of drive vehicle illicit drug present in blood. Mr Davidson allegedly returned a positive reading to methylamphetamine on the Pacific Highway in South Kempsey on February 1. The matter was referred from a mention from Kempsey court on May 7. The matter was adjourned until June 21.
ENGLLEBRECHT, Jamie, a 30 year old from Scone had charges of common assault and stalk/intimidate intend to fear physical harm etc. The complainant did not appear in court and the matter was adjourned for hearing on May 31 in Tamworth.
EWEN, Peter Robert, a 62 year old from Paddington entered a written plea of guilty to a charge of exceed speed by more than 10 kilometres an hour on November 16 at Balndford. The matter was sent to Waverly for mention on June 5.
FARROW Mechanical Pty Ltd v Melanie Dewitt. Ms Grant a secretary for Farrow Mechanical appeared in a civil dispute and produced evidence that Ms Dewitt had been credit back for stereo equipment and the matter was dismissed.
FISHBURN, Thomas Edward, a 33 year old from Scone had charges of use offensive language in/near public place/school, assault police officer in execution of duty without actual bodily harm, two counts of possess prohibited drug and two charges of rider not wear approved bicycle helmet/fitted/fastened. The alleged offences of assault police officer and use offensive language occurred on August 17 in Sydney Street, Scone. On October 27, it is alleged Mr Fishburn was in possession of 1.5grams of methylamphetamine and also rode a bicycle on Scott Street, Scone without wearing a bike helmet. On November 18 it is alleged Mr Fishburn was found in possession of 0.8 grams of methylamphetamine in Scone. The matters were adjourned until June 22.
FOGARTY, Dianna Gai, a 71 year old from Scone had a charge of exceed speed by more than 30 kilometres an hour. The alleged offence occurred on the New England Highway in Aberdeen on January 28. The matter was set for hearing on July 20 with speed zone locations a matter in issue.
GOLLEDGE, Wayne Thomas, a 34 year old from Nundle had a charge of drive, licence suspended under section 66 of the fines act in Scone on March 29. A plea of guilty was entered and a good behavior bond of 12 months was entered into.
HEYCOX, Patrick William, a 45 year old from Cassilis pled guilty to a charge of possess prohibited drug. The drug was 1.2 grams of cannabis which was in his possession on August 25. Mr Heycox was convicted and fined $250.
HOULTON, Jesse Gary John, a 25 year old from Wollar had charges of assault occasioning actual bodily harm, stalk/intimidate intend fear physical harm, destroy or damage property and common assault. The alleged offences occurred on October 3 in Merriwa when Mr Houlton had a dispute over a car with Mr Dale Daniel and is alleged to have punched Mr Houlton in the head and damage his car. The matters were adjourned until July 20.
IONGI, Sione Ofa-He-Mooni, a 23 year old from Scone had a charge of assault occasioning actual bodily harm. The alleged offence occurred on February 4 in Scone. The matter was adjourned until June 21. There is a dispute over the statement of facts.
JOHNSTON, Scott Noel, a 47 year old from Merriwa had a charge of not keep firearm safely – not prohibited firearm/pistol. He was given a 2 year goof behavior bond.
KEEGAN-CRANE, Leighton Toby, a 19 year old had charges of drive with middle range prescribed concentration of alcohol, P1 driver exceed speed >45km/h and not comply with P1 licence-no P plates. He was found guilty and given a $300 fine, 18 months good behavior bond and $300 fine for the charge of middle range PCA. He was fined $500 for the speeding offence and dealt with under S10a for having no P plates.
KERR, Karmen Jade, a 28 year old from Aberdeen had a charge of drive motor vehicle while licence suspended. The alleged offence occurred at 9:20am in April 10 in Joan Street, Scone. The matter was adjourned until July 19.
KOPCOK, Drasco, a 37 year old from Muswellbrook had a charge of enter enclosed land not prescribed premises without lawful excuse in Oxford Street, Scone on March 23. Mr Kopcok did not appear in court and was in custody on other matters. The matter was adjourned to Tamworth court on June 4.
LOUIS, Shane Anthony, a 21 year old from Scone had a charge of provisional driver class R drive motor cycle more than 660ml/150 kw/t in Scone on February 22. He was given a bond to be of good behavior for 12 months.
MAPPERSON, Ian Robert, a 19 year old from Scone had a charge of acquirer fail to apply for transfer of registration. A guilty plea was entered and the matter was dismissed under S10 (1)(a).
MILES, Martin Thomas, a 26 year old from Coopernook had a charge of goods in personal custody suspected stolen – NSW registration plates from an incident in Scone on May 3.
PRESTON, Shane Troy, a 36 year old Tamworth had a matter of resist officer in execution of duty. The matter was adjourned for a mental health assessment bail to continue June 19.
PRINGLE, Damon, a 45 year old from Scone failed to appear for a revocation of a community service order for which he has failed to comply with. The matter was adjourned until June 20 where if Mr Pringle does not attend the matter will be dealt with in his absence.
PROBERT, Tina Natalie, a 32 year old from Muswellbrook had charges of drive vehicle, illicit drug present in blood, drive motor vehicle while licence suspended and drive vehicle under influence of drugs from an incident at Glenbawn Dam on November 2. Ms Probert plead guilty to having methylamphetamine and delta 9 tetrahydrocannibinol present in her blood. She was fined $300 and disqualified for 6 months. On the charge of drive while suspended she undertook a S9 bond to be of good behavior for 18 months and on the charge of drive under the influence she received a 6 month disqualification and a 7 month suspended sentence of imprisonment.
RANDLE, Jonathan Wharton, a 43 year old from Scone had a charge of from the RMS of – not notify changes in construction, use etc of heavy vehicle from an incident on November 13. A guilty plea was entered and he was given a bond to be of good behavior for 12 months.
RAWLINSON, Darryl John, a 42 year old from Scone plead guilty to a charge of drive, licence suspended under section 66 of the fines act from an incident in Scone on December 6. Mr Rawlinson was disqualified from driving for three months and fined $400.
ROWE, Jason Noel, a 43 year old from Bunnan appeared in custody on charges of stalk/intimidate intend fear and two counts of destroy or damage property less than or equal to $2,000. Mr Rowe was found guilty and given an aggregate sentence of seven months goal with a five month non-parole period.
SIEVERS, Natalie Clare, a 31 year old from Heatherbrae had charges of destroy or damage property less than or equal to $2,000 and possess prohibited drug. Ms Kim McGrath gave evidence that Ms Sievers had approached the home of Ms McGrath and threatened “I’m going to slit your #*&%ing throat,” while holding a block of wood. She said Ms Sievers threw the lump of wood at her car causing damage. Ms Sievers denied the incident and said Ms McGrath had been swerving her car towards her on several occasions when she was walking. She claimed Ms McGrath had again swerved towards her when she told her to “stop it”. She denied carrying a block of wood or damaging the car. The court also hear the testimony of Ms Marie McInnes a neighbor of Ms McGrath who said she had heard an altercation and a “bang” which prompted her to come outside and investigate. She said she saw Ms Sievers and Ms McGrath having a “very loud discussion”. The Magistrate asked Ms Sievers if she ahd reported the incidents of Ms McGrath swerving towards her in the car to police. Ms Sievers said she had but nothing had been done. The Magistrate asked Ms Sievers if she had received an “event number” from police to record her complaint, however Ms Sievers said she had never received a number for any of her complaints. The Magistrate said the evidence of Ms McGrath was collaborated by Ms McInnes to a certain extent and further noted her concern that this was the second such incident on Ms Sievers record. Ms Sievers was given a section 9 supervised good behavior bond for 18 months. For the charge of cannabis in Ms Sievers possession the Magistrate noted it was a small amount for personal use for which she was convicted and fined $200.
SQUIRES, Chad William, a 23 year old from Scone plead guilty to a charge of drive vehicle, illicit drug present in blood being cannabis and methamphetamine from an incident in Scone on December 28. Mr Squires was disqualified from driving for three months and fined $250.
SULLIVAN, Victoria Anne, a 33 year old from Scone had charges of drive recklessly/furiously or speed/manner dangerous, never licenced person drive vehicle on road and drive with high range prescribed concentration of alcohol from an incident in Scone on March 23. It is alleged that with an alcohol reading of 0.203 Ms Sullivan drove at Bill Rose Sporting Complex narrowly missing adults and children before crashing her vehicle on Liverpool Street and being detained by witnesses as she attempted to leave the scene. She was granted conditional bail to attend court on June 21.
UPPER HUNTER SHIRE COUNCIL v FRASER, George. In a civil matter Upper Hunter Shire Council sought to recoup outstanding money from Mr George Fraser. Mr Fraser produced evidence of payment and the matter was dismissed.
WARE, Mitchell William, a 31 year old from Morisset had a charge of drive with middle range prescribed concentration of alcohol. The offence occurred on February 1 in Scone when Mr Ware returned a reading of 0.085 during random breath testing. The police also noted Mr Ware was exceeding the speed limit. Mr Ware said he had consumed two 750ml bottles of Toohey’s New in a rest stop in Gennedah. Mr Ware said he was driving from Narrabri and was intending to drive home to Morisset. It was noted by the Magistrate that Mr Ware came to the attention of police because of the manner of his driving. It was also noted he was only just in the mid-range of drink driving. The six month licence disqualification was backdated and he was fined $500.
WATSON, Kayla Maree, a 25 year old from Tamworth entered a written plea of guilty to drive, licence suspended under section 66 of the fines act. The matter was adjourned for sentencing to Tamworth court on June 5.
WRIGHT, Leonie, a 46 year old from Scone had a charge of drive vehicle, illicit drug present in blood – second offence. Ms Wright allegedly returned a positive reading to methylamphetamine on November 22 in Maitland Street, Muswellbrook. The matter was adjourned until June 21.
