THE following matters were before Scone court this month:

BALL, John Bryan, a 22 year old from Peak Hill entered a written plea of guilty to a charge of drive motor vehicle while licence suspended – second offence. The offence occurred at approximately 12:50pm, on May 21 in Merriwa. Mr Ball was convicted, fined $400 and disqualified from driving for 12 months.

BATES, Kelly Ann, a 28 year old from Muswellbrook pled guilty to a charge of not comply P1 licence-no P plates (class C). Ms Bates had been pulled over for a random breath test and while she had her rear P plate on display the front P plate was missing. She was given a conditional release order to be of good behavior for 12 months with no conviction recorded.

BRENNAN, John William, a 40 year old from Scone appeared unrepresented on a charge of resist or hinder police officer in the execution of duty from an incident on May 31 in Scone. See co-accused Trey Brennan for details of the alleged offence. John Brennan’s matter was adjourned until July 18 to allow him to seek legal advice.

BRENNAN, Trey, a 19 year old from Scone appeared and pled guilty to charges of destroy or damage property and resist or hinder police in execution of duty. The offences occurred on May 31 at approximately 11:40am in Scone, when damage was caused to a Ford Ranger, owned by the NSW Police. Mr Brennan and his father (co-accused) John William Brennan were ejected from the Belmore Hotel in Scone due to intoxication. John Brennan believed Trey Brennan’s drink had been spiked and called 000. John Brennan is alleged to have been abusive towards the 000 operator and failed to answer questions. Police located the pair on the corner of Liverpool and Hill Streets in Scone. John Brennan, police allege, was abusive to them yelling “what the fuck, don’t you want me living in your town? We fucking called you for help because my kid’s been drink spiked and you’re giving us attitude.” Trey Brennan leant forward onto the mud guard of the police vehicle and was asked not to lean on the vehicle. John Brennan is alleged to have then yelled, “he can’t fucking stand up, he’s too pissed.” Police asked Trey Brennan to sit on the grass, however Trey yelled, “fuck you dog cunts I’ve been spiked”. As he said this, he swung his left arm in an overhead manner smashing it down onto the windscreen of the vehicle damaging it. Police existed the vehicle to place him under arrest. They walked away from police and when told to stop replied, “get fucked you peddo cunts.” In the process of making the arrest Constable Barry’s shirt collar was yanked, tearing the collar. John Brennan is alleged to have continued to resist arrest also and strike out at Constable Barry. Constable Barry deployed a one second burst of Oleo resin capsicum spray into the face of John Brennan and then helped Constable Moore restrain Trey Brennan. Trey Brennan had grabbed Constable Moore around the waist in a bear hug trying to push her to the ground. Constable Barry also used capsicum spray on Trey Brennan. While police were restraining the Trey, it is alleged John attempted to run from the scene, however due to the effects of the capsicum spray he was unable to see and fell heavily, face first onto the concrete footpath. Police attempted to handcuff John however it is alleged he continued to resist violently striking out at police with his arms and feet. Eventually both men were forced into the rear of the police cage vehicle and had to be forcibly removed when they arrived at the police station in Scone. Ambulance officers were called to treat both men for the effects of the spray. Due to their aggressive natures they were transferred to Muswellbrook police station and again aggressively resisted and had to be forcibly loaded into the police caged vehicle. While in custody at Muswellbrook it is alleged John Brennan continued to yell abuse towards police. Trey Brennan is to be of good behavior for 12 months, no conviction was recorded and was ordered to pay NSW Police $590 in compensation for damages to their vehicle.

BROWN, Gregory Robert, a 61 year old from Scone appeared unrepresented to pled not guilty to a charge of contravene prohibition order. Mr Brown is the subject of a child protection prohibition order and he is alleged to have breached the order on January 29 in Scone. The orders alleged to have been breached include that he approached, actively sought or remained in the presence of company of any person under the age of 18 years and actively communicated or attempt to communicate (directly or indirectly) with a person under the age of 18 years. , the matter was adjourned for hearing to August 23.

BURGE, Bradley Harris, a 39 year old from Bunnan had a charge of possess prohibited plant, small quantity. The alleged offence occurred on February 20 in Bunnan and relates to three cannabis plants. The matter was adjourned until July 18.

BYRNE, Mathew Paul, a 45 year old from Murrurundi had a charge of common assault relating to an incident on June 14 in Murrurundi. The matter was adjourned until July 18.

CARRIGAN, John Patrick, a 28 year old from Merriwa appeared represented and pled guilty to charges of Use Class B or C vehicle number plate obscured/defaced and Drive with low range prescribed concentration of alcohol – first offence. The offence occurred on April 27 on Bettington Street, Merriwa at approximately 11:15pm. The alcohol level recorded was 0.072. Mr Carrigan consumed four stubbies of Great Northern beer over an hour and had not consumed any food during that time. Mr Carrigan was found guilty of the drink driving offence with no conviction recorded and ordered to be of good behavior for 12 months. On the charge regarding the number plate, photos were produced and the charge was dismissed.

COOPER, Glenn Albert, a 46 year old from Gunnedah appeared unrepresented and pled guilty to a charge of possess or use a prohibited weapon without permit. On May 14 Mr Cooper was stopped by police for a random breath test in Scone and told police he had dropped a friend off in Singleton and was travelling home to Gunnedah. The police thought he appeared nervous and since the New England Highway is a known route for trafficking drugs, they asked to search the vehicle. During their search they found a knife of flick-blade design, which is a prohibited weapon. They also found a ;fit kit’ used for disposing of used syringes. Mr Cooper was convicted and fined $250.

CUNNINGHAM, Michael, a 45 year old from North Lambton appeared represented in court on a charge of assault occasioning actual bodily harm. The offence occurred on June 23, 2018 at approximately 3:20pm, when Mr Cunningham assaulted Mr Peter Duggan. Mr Cunningham was convicted, given a community correction order to be of good behavior for 15 months and must comply with conditions of a treatment plan.

DE BEAUX, Jonathan Charles, a 46 year old from Bentley had a charge of approach pedestrian crossing too quickly to stop safely. The alleged offence occurred on April 8 at 3:45pm on Bettington Street, Merriwa. The matter was set down for hearing on July 19.

DOUGLAS, Jason James, a 46 year old from Tamworth, pled not guilty to charge of larceny, relating to stealing a Comfit Pro bag containing Dreamline XG lawn bowls the property of Raymond Wilson on June 28 in Scone, valued at $550. The matters were adjourned until July 18.

EDWARDS, Paul Campbell, a 51 year old from Upper Orara was represented on charges of affray and common assault. The alleged incident occurred on January 1 in Moonan Flat when Mr Edwards used unlawful violence towards Terry Langham. Dominique Gunner is co-accused of assaulting Terry Langham. The matter was set for hearing on October 25.

EVELEIGH, Ryan, a 27 year old from Sandy Hollow appeared unrepresented and pled guilty to a charge of never licensed person drive vehicle on road. The offence occurred on April 12 in Wyong at approximately 10am. Mr Eveleigh was convicted of the offence.

Far Western Stone Quarries Pty Ltd was brought to court by the Department of Planning and Environment on charges of Fail to pay annual rental fee or annual administrative levy, Person identified fail to comply with direction or notice, fail to prepare or lodge report as prescribed. Director Antony Martin was on hand as a director and also faced two personal charges relating to the company of Contravene order re specified ancillary mining activity. The quarry has since closed and the charges related to rehabilitation works of the site. The company had agricultural liabilities as well and the drought conditions meant that financial means were concentrated there along with health issues of Mr Martin. Mr Martin was convicted and fined a total of $12,000.

FINLAY, Keizer, a 44 year old from Baradine appeared represented and pled guilty to a charge of Drive, illicit drug present in blood etc – first offence. The offence occurred on February 23 at Coonabarabranat approximately 3:24pm when Mr Finlay tested positive to methamphetamine and delta-9-tetrahydrocannabinol. He was convicted, fined $300 and disqualified from driving for four months.

FISHBURN, Thomas Edward, a 34 year old from Scone was represented on charges of goods suspected stolen in/on premises, possess  or use prohibited weapon without permit, two counts of possess unauthorised pistol, one count of possess unauthorised prohibited firearm and one count of owner/occupier knowingly allow use as drug premises. The matters were set for hearing on September 20.

FOX, Aaron Steven, a 40 year old from Aberdeen appeared in court and pled not guilty to charges of common assault, stalk/intimidate intend fear physical etc harm and destroy or damage property. The alleged offences occurred on April 22 in Aberdeen, with a mobile phone and a car key being destroyed. The hearing was set down for September 20.

GOOCH, Kevin Adam, a 34 year old from Scone appeared and pled guilty to charges of drive with high range prescribed concentration of alcohol – second offence and licence expired less than two years before – first offence. On Saturday, June 1 at approximately 4:35pm police were patrolling Scone and could hear the loud revving of a V8 vehicle. Police then observed a blue coloured vehicle turning right into Liverpool Street from Hill Street. The vehicle was then observed to overtake another vehicle, causing the lead vehicle in oncoming traffic to move to the left of the road to avoid a collision. Police activated their lights and sirens and followed the vehicle. The vehicle turned right into a property on Moobi Road. Police asked the driver to produce his drvier’s licence and they observed Mr Gooch’s slow and slurred speech. They breath test Mr Gooch who returned a reading of 0.167. Mr Gooch’s licence had expired in May 2019. Mr Gooch said he had consumed six schooners of Great Northern mid strength beers. He had begun drinking at the Scone Rugby Union Club at 12pm and has his last drink at 4:15pm and did not consume food during this time. Mr Gooch will complete the traffic offenders program and the matter was adjourned until August 2 for sentence.

GREENALL, Vicky, a 48 year old from Scone was represented on charges of Drive with middle range PCA 1st offence, Learner not accompanied by driver/police officer/tester and Learner driver not display “L” plates as prescribed. The matter was adjourned to July 18 to allow time for the Traffic Offenders Program to be completed.

GUNNER, Dominique, a 46 year old from Moonan Flat was represented on charges of common assault and affray. It is alleged Gunner assaulted Mr David Hollinger and Terry Langham on January 1 in Moonan Flat in an incident involving Paul Campbell Edwards, who is co-accused of assaulting Terry Langham and Michael McCormick is co-accused of assaulting David Hollinger. The matter was set for hearing on October 25.

HAWKSHAW, Jack William, a 22 year old from Scone had charges of stalk/intimidate intend fear physical etc harm and destroy or damage property. The alleged offences occurred on May 11 in Scone when Mr Hawkshaw destroyed a decorative lantern and a letterbox. The matters were adjourned until July 18.

HEWETSON, Melissa Jane, a 48 year old from Scone appeared on a charge of Class A m/v exceed speed 30km/h in the roadwork zone approaching Scone from the south. Ms Hewetson had already completed the traffic offenders program and was placed on a community release order for 12 months with no conviction recorded.

HJORRING, Tony George, a 50 year old from Scone pled guilty to a charge of drive with low range concentration of alcohol – first offence. The offence occurred on May 5 on Satur Road Scone when Mr Hjorring returned a reading of 0.054. Mr Hjorring said he had consumed three 330ml bottles of 150 lashes between 5pm and 7:25pm at a friend’s house. The matter was adjourned until July 18.

HOWLAND, Robert Paul, a 44 year old from Muswellbrook appeared unrepresented and pled not guilty to a charge of common assault. The alleged offence occurred on November 11 at Glenbawn Dam. The matter was adjourned to July 18.

ISSA, Rohan V, a 27 year old from Scone appeared represented and pled guilty to a charge of drive with middle range prescribed concentration of alcohol – first offence. The offence occurred on May 3 in Scone when Mr Issa returned a reading of 0.128 when tested on Liverpool Street, Scone at approximately 11:30pm. Police observed an open bottle of great northern beer in front console which was poured onto the roadway. They also observed Mr Issa to have slurred speech and he was reluctant to follow simple instructions. Mr Issa told police he had consumed seven bottles of 330ml Great Northern mid strength beer between 5pm and 11:20pm that evening and eaten approximately six slices of pizza. Mr Issa had already completed the traffic offenders program, he was disqualified from driving for three months, will have a mandatory interlock period of 12 months and fined $500.

JOHNSEN, Benjamin Michael, a 30 year old from Moobi appeared in court on charges of not keep firearm safely – not prohibited firearm/weapon and not keep firearm safely – not prohibited firearm/pistol and guilty to a charge of possess prohibited drug. The alleged offences occurred on April 30 in Willow Tree when Mr Johnsen was in possession of a 0.223 calibre Sako firearm and a 0.22 calibre Puma which police alleged was not kept safely. The matter was set for hearing in Tamworth on August 22.

JONES, Reece Michael, from Scone appealed a licencing decision. Mr Jones will attend the traffic offenders program and the matter was adjourned until July 18.

KELLY, Jason Charles, a 46 year old from Muswellbrook pled guilty to a charge of drive with high range prescribed concentration of alcohol – second offence. The offence occurred on December 22 when Mr Kelly returned a reading of 0.254 on Sydney Street, Muswellbrook. Mr Kelly had run into a telegraph pole at the intersection of Maitland Road and Sydney Street, Muswellbrook at approximately 11:16pm. Mr Kelly told police he had his first drink at 3pm and did not recall when he had his last drink. He consumed 10 to 12 schooners of Toohey’s New beer and two cans of Canadian Club at a friend’s place and did not eat any food. Mr Kelly was convicted, disqualified from driving for six months, will have a mandatory interlock period of 24 months and has a supervised intensive correction order for 10 months.

KENNEDY, Douglas Ashley, a 26 year old from Scone had four counts of common assault and one count of take action that results in physical injury/sexual abuse. The allegations relate to incidents that range from November 2015 until November 2018. The matters were adjourned for hearing in Tamworth on August 16.

KERRY, Rhiannon, a 25 year old from Muswellbrook pled not guilty to charges of larceny. The alleged offence occurred on December 14 and December 18 when Ms Kerry is accused of stealing one size 3 Cowbaby Cool navy and brown kids cowboy boots, one size 3 CowBaby big chief blue and brown kids cowboy boots property from Marsh Carney valued $109.90. The matters were adjourned until July 18.

KIEM, Dylan James, a 26 year old from Muswellbrook appeared and pled guilty to charges of possess prohibited drug, supply prohibited drug small and indictable quantity, goods in custody suspected stolen, possess suspected proceeds, money/property less than $100,000 and drive motor vehicle while licence suspended. On February 11 at approximately 11:15 am police conducted a check on Mr Kiem’s vehicle while they were in a line of traffic and their records showed the driver of the vehicle had a suspended licence. Police pulled over Mr Kiem and he admitted to having a suspended licence. Police noted Mr Kiem seemed nervous and asked him if there was anything in the vehicle and he stated, “yeah, just a small amount of pot”. Police conducted a search and found $1,700 in his wallet, which he claimed was from Centrelink. Police asked if he could produce a receipt, but Mr Kiem did not answer them. Police asked who owned a grey back pack in his car to which he replied “not me”. Police asked where the pot was and he replied “in the middle pocket” of the backpack. Police located a large bag of pot, weighing 411.65 grams and several small bags of pot weighing 2 grams. Police removed a black bag from the back pack and found a set of scales, more pot and an ice pipe. Police also located a lock box which contained three bundles of $50 notes totaling $1,000 and another bundle of $650 with nine $50 notes and ten $20 notes. Mr Kiem said shortly after 8am he had given an unknown man, who he couldn’t describe, a lift down Kelly Street to Coles. He told police the unknown male had offered him some pot and showed him the contents of the back pack. The unknown male left the bag in Mr Kiem’s car and went into Coles at approximately 9am. Mr Kiem then told police he drove to Guernsey Street to catch Pokemon, before being stopped by police.  When pressed for details, Mr Kiem was unable to account for the approximately two hours between dropping the unknown man off and being pulled over by police. Police asked Mr Kiem if he thought it was odd an unknown man would leave pot and large quantities of cash with him, to which Mr Kiem did not answer. He then claimed the cash was from the sale of a car, however he had no receipt, details of the person he sold it to or transfer papers. Eventually he told police he had not sold a car and in relation to his initial story to police he said, “there was no male, it’s mine.” A pre-sentence report was ordered and the matter was adjourned to August 22.

KILROY, Reece, a 23 year old from Scone had charges of common assault and enter enclosed land not prescribed premises without lawful excuse. The offence occurred on December 20 at approximately 3pm in Scone. Mr Kilroy was ordered by the court to comply with a treatment plan.

LARVAY, Zachary, a 23 year old from West Tamworth pled guilty to a charge of possess prohibited drug. The offence occurred on April 24 in Blandford at approximately 5:20pm when Mr Larvay was involved in a collision and was found in possession of methylamphetamine weighing 1.8 grams. Mr Larvay had what police described as “an extensive criminal history” including serious offences such as robbery and was on parole at the time of the offence. Mr Larvay was convicted and fined $400.

LAWLOR, Richard, a 78 year old from Scone appeared to appeal the decision of the RMS who cancelled his licence after failing several HV licence tests and one class C licence test. Mr Lawlor wanted the opportunity to be able to undertake a class C licence test and the appeal was allowed.

LOUIS, Shane Anthony, a 22 year old from Scone pled not guilty to charges of destroy or damage property, assault occasioning actual bodily harm, common assault, stalk/intimidate intend fear physical harm and two counts of use carriage service to menace. The alleged offences relate to an incident between 6pm and 11pm on February 3 in Scone. The alleged damage is to a Medicare card. The matter was adjourned for hearing on October 25.

MACAULAY, Casey Jonell, a 37 year old from Singleton appeared for sentence on charges of handle explosive/precursor without authorising licence and negligently handle explosives to endanger person’s life. A treatment plan was set in place with the pre cursor that if it is not followed the matter will be back in court.

MCCORMICK, Michael John, a 50 year old from Wyong PNG on charges of assault occasioning actual bodily harm and affray. The charges relate to an alleged assault of David Hollinger on January 1 in Moonan Flat and is co-accused with Dominique Gunner. The matter was set for hearing on October 25.

MITA, Rangi Paiaka, a 38 year old from Scone had a charge of drive, licence suspended under s 66 fines act – second offence. The offence occurred in Scone on February 11. He was convicted fined $600 and disqualified from driving for 12 months.

NEBAUER, Jake, a 36 year old entered a written plea of guilty to a charge of affray. The offence occurred in Merriwa when Mr Nebauer threatened Matthew and Katie Spitiri. The police facts detail Mr Nebauer said he would “burn the house down with your kids in it.” The matter was adjourned to Albury on July 8.

ORR, Joshua Patrick, a 19 year old from Scone pled not guilty to break enter dwelling – house etc with intent. The alleged offence occurred on January 9 at approximately 12pm on Gundy Road, Scone.  The matter was adjourned until July 18.

PARRY, Pamela Francis, a 52 year old from Scone had a charge of never licensed person drive vehicle on road-first offence. The offence occurred on February 15 in Denman. The matter was adjourned until July 18.

PICKERSGILL, Amy Lee, from Denman appealed a decision by the Roads and Maritime Services. The matter was dismissed and the licence suspension varied to seven days.

PINKERTON, Ashley John, a 39 year old from Parkville had a charge of drive with middle range prescribed concentration of alcohol – second offence. The prosecution amended the charge to first offence. The offence occurred on April 12 in Wingen, at approximately 11:15pm, when Mr Pinkterton returned a reading of 0.149. Mr Pinkteron told police he had consumed seven schooners of Great Northern beer since 7pm and did not eat any food during that time. Mr Pinkterton will complete the traffic offenders program. The matter was set down for sentence on July 18.

PINKERTON, William Graham, a 30 year old from Moonan Flat pled guilty to a charge of never licenced person drive vehicle on road. The offence occurred on March 19 in Scone on the New England Highway. Mr Pinkerton was not convicted and given a conditional release order for 12 months.  

PINKERTON, William Alan, a 53 year old from Scone pled guilty to a charge of never licenced person drive vehicle on road – first offence. The offence occurred at approximately 10:50am on May 20 at Segenhoe. Mr Pinkteron was pulled over by police for a random breath test, when police found he was unlicenced. Mr Pinkteron was not convicted and given a community release order for 12 months.

PRUDDEN, Lucy Margaret, a 23 year old from Scone had a charge of drive with middle range concentration of alcohol. The alleged offence occurred on May 4 on Main Street, Scone when Ms Prudden returned a reading of 0.102 after consuming 3 to 4 beers then a vodka and red bull at home. The matter was adjourned until July 18.

RILEY-LEWIS, Shay Louise, a 42 year old from Scone pled guilty to drive across dividing lines to do u-turn-motor vehicle and driver use mobile phone when not permitted. Ms Riley-Lewis was given a conditional release order 14 months for using a mobile phone and a conditional release order for 12 months for driving across lines.

RAWLING, David Grant, a 39 year old from Scone pled guilty to common assault. The offence occurred on June 17 in Scone. A presentence report was ordered and the matter was adjourned until August 22.

RYAN, Aaron John, from Merriwa entered a written plea of guilty to charges of drive motor vehicle while licence suspended – first offence and two counts of drive with middle range prescribed concentration of alcohol – first offence. The first offence occurred at 8:15pm on Bettington Street, Merriwa when Mr Ryan walked towards his vehicle and was observed by police to be unsteady on his feet. They performed a random breath test and he returned a reading of 0.141. Mr Ryan told police he had consumed seven stubbies of Toohey’s New beer within half an hour of being breath tested. The next offence occurred the same day at 10:45pm when Mr Ryan was observed driving and pulled over by police. They performed another breath test and he returned a reading of 0.125. He told police he had consumed seven long necks of Toohey’s New beer on the side of an unknown road earlier that day, but had not consumed any more since being released from the police station. The matter was adjourned to Bathurst on July 3.

SAUNDERS, Clinton John, a 23 year old from Scone had two charges of assault occasioning actual bodily harm, one charge of stalk/intimidate intend fear physical harm and one charge of armed with intent to commit indictable offence. The alleged offences occurred on September 1 in Scone at approximately 9pm. Weapon was a knife.  A pre-sentence report was ordered and the matters were adjourned until August 12.

SAUNDERS, Haylee Patricia, a 21 year old from Scone pled guilty to charges of novice driver drive with novice range prescribed concentration of alcohol – first offence and learner driver not display “L” plates as prescribed. The alleged offences occurred on April 19 when Ms Saunders returned a reading of 0.012 on Kelly Street, Scone. The matter was adjourned to July 18 for sentencing and to allow time to complete the traffic offenders program. Ms Saunders told police she had consumed one vodka and cola before driving.

SPITERI, Matthew, a 41 year old from Merriwa pled not guilty to charges of exclude person fail to leave premises when required, resist officer in execution of duty, use offensive language in/near public school and intimidate police officer in execution of duty. The charges relate to an alleged incident at Cassilis Rodeo in February. The matter was adjourned to July 18.

SQUIRES, Chad William, a 24 year old from Scone pled not guilty to charges of goods suspected stolen in/on premises and guilty to drive vehicle, illicit drug in blood – second offence. Mr Squires was convicted of goods suspected stolen, which were 31 BCF gift cards valued at $2,700, on October 2 in Scone and fined $150. He was also convicted for drive with illicit drug, on March 14 in Scone, fined $300 and disqualified from driving for 12 months.

STEEPE, Jason Edward, a 46 year old from Scone appeared represented on charges of assault occasioning actual bodily harm, common assault and armed with intent to commit indictable offence. The alleged offences occurred on March 30 in Scone at approximately 1:30pm and the weapon was a metal pole. The matter was adjourned to July 18 where a plea must be entered.

TELFER, Callum Robert, a 20 year old from Merriwa appeared for sentence for a charge of special category driver with special range prescribed concentration of alcohol. The offence occurred on April 4 on William Street, Merriwa when Mr Telfer, a p-platter, returned a prescribed concentration of alcohol reading of 0.043. No conviction was recorded and he was given a bond to be of good behavior for 12 months.

TRAISE, John William, a 55 year old from Quirindi had charges of drive with middle range concentration – first offence. The offence occurred on January 24 on Kingdon Street, Scone, when he returned a reading of 0.126. Mr Traise told police he had consumed six 375ml Toohey’s New beer between 12pm and 4pm that day. He was convicted, disqualified from driving for 6 months, will have a mandatory interlock period of 12 months and a supervised community corrections order for 18 months.

TYLER, Fiona Mary, a 35 year old from Neutral Bay entered a written plea of guilty to exceeding the speed limit by 30km/hr on April 7 in Scone. Ms Tyler was not convicted and the case was dismissed.

WALL, Sarah, a 44 year old from Murrurundi pled guilty to charges of negligent driving and drive with high range prescribed concentration of alcohol. The offences occurred on September 26 at Murrurundi at approximately 9:45pm on Mayne Street, Murrurundi. Ms Wall was travelling southbound in the northbound lane, causing a b-double to take evasive action and steering to the left of the road. Ms Wall collided into the rear trailer of the b-double truck causing damage to the truck and her own car. Ms Wall later told police, “I actually cannot recall the collision I remember seeing the turn up ahead opposite the Royal Hotel Murrurundi. Next thing I remember the windscreen smashing a truck ahead of me I don’t know if I fell asleep, I missed the turn I hit the truck.” Ms Wall told police she had consumed three beers, four hours prior to the crash at the Royal Hotel. For negligent driving Ms Wall was convicted and fined $150. For high range drink driving, with a reading of 0.211, she was convicted, disqualified from driving for 7 months, a mandatory interlock for 24 months and an intensive correction order for 9 months.

WARNER, Alexander, a 44 year old from Scone pled guilty to a charge of exceed speed limit by 20 km/hr. Mr Warner will complete the traffic offenders program and the matter was adjourned until August 22.

WATKINS, Gregory Ernest, 62 year old from Coffs Harbour pled not guilty to both enter private land to hunt animal without owner consent and hunt game animal on private/pblic land without consent. The alleged offences occurred on August 22 and February 2 in Murrurundi. The matters were adjourned until August 22.

WATSON, Chad James, a 21 year old from Tanilba Bay entered a written plea of guilty to drive motor vehicle during disqualification period – second offence. The offence occurred on May 21 in Merriwa. It was noted in the police facts that Mr Watson had “a lengthy traffic record for his age”. The matter was adjourned to Raymond Terrace on July 8.

WHITELEY, Jason Michael, 48 year old from Merriwa pled guilty to a charge of low range drink driving and drive with middle range concentration of alcohol. The first offence occurred on May 15 at approximately 4:30pm on Marquet Street, Merriwa when Mr Whiteley returned a reading of 0.072.  Mr Whiteley told police had had consumed three schooners of light beer at the Royal Hotel and a 750ml long neck of Victoria Bitter. The second offence occurred at approximately 9:20pm the same day, when Mr Whiteley returned a reading of 0.116 on the Golden Highway. When Mr Whiteley exited his vehicle he was observed to be unsteady on his feet and was aggressive towards police. A pre-sentence report was ordered and the matters were adjourned until August 22.

WHITEHEAD, Ashley Louise and POWER, Zoe appeared for hearing on a noise abatement matter. There were issues with evidence being relied upon for the hearing not being served. All relevant documents were served in the courtroom and the matter was relisted for hearing on an extra hearing day set by Magistrate Soars in Scone on August 12.

WILSON, Lee Anthony, a 30 year old from Scone had a charge of destroy or damage property less than $2,000 and a charge of destroy or damage property more than $5,000. The alleged property damaged was a Nissan Patrol which is the property of NSW Police. The offences are alleged to have occurred at approximately 12:30am on October 7 in Scone. The matter was set down for hearing on October 25.
