Matters before the Scone Local Court this month included:
ATKINSON, Melissa, a 32 year old from Scone pled guilty to a charge of drive with low range prescribed concentration of alcohol. The offence occurred between 10:48pm and 10:53pm on August 3 on Satur Road, Scone when Ms Atkinson returned a breath analysis test of 0.064. Ms Atkinson told police she had consumed three alcoholic drinks throughout the evening from 6pm until 10pm, which were two wines and one glass of champagne. Ms Atkinson was given a community corrections order for 18 months.
COOPER, Colin, v GILBEY, Janice. Ms Gibley made an application for order determining fencing work. The matter was settled in mediation through the Community Justice Centre and dismissed.
DALY, Adam, a 27 from Aberdeen appeared before the court and pled guilty to a charge of drive with low range prescribed concentration of alcohol. The offence occurred at approximately 12:02am on August 18 on Kelly Street, Scone when Mr Daly returned a reading of 0.075. Mr Daly told police he had consumed five schooners of full strength beer from 8pm until 11pm at the Willow Tree Hotel. Mr Daly will complete the traffic offenders program and the matter was adjourned until December 20 for sentencing.
ELLIS, Robyn, a 31 from Scone made an appeal to the court on a decision by the Roads and Maritime Services. The matter was adjourned until December 21.
ENGLEBRECHT, Jamie, a 30 year old from Scone appeared on charges including drive vehicle, illicit drug present in blood and common assault. Mr Englebrecht returned a positive reading to methylamphetamine and delta-9-tetrahydrocannabinol at approximately 11:50pm on June 5 on Liverpool Road, Scone. Mr Englebrecht is to complete the traffic offenders program. The matter was adjourned until November 22.
FAHEY, Laura Edna, a 51 year old from Merriwa pled not guilty to a charge of knowingly drive vehicle in manner menaces other and guilty to use unregistered registerable class A motor vehicle on road. The matter was adjourned until November 22.
GORTON, Cindy Lee, a 24 year old from Wingen had a charge of refuse or fail to submit to breath analysis. It is alleged the offence occurred at approximately 10:50pm on August 26 in Scone. The matter was adjourned until December 20.
GREEN, Derek Ernest Lee, a 24 year old from Scone appeared and pled guilty to a charge of drive with high range prescribed concentration of alcohol. The offence occurred at approximately 9pm on September 29 when Mr Green returned a reading of 0.150 on Gundy Road, Scone. Mr Green holds a united States of America driver’s licence and is working locally as a veterinarian assistant. Mr Green told police he had consumed five 35ml full strength beers between 9am and 8pm, but had not consumed food throughout the day. The defence argued that the reading was at the low end of the high-range reading, but the prosecution argued it was still a high reading which poses a risk to the community. While Magistrate Soars noted his good driving record and references she said it was a serious offence and urged him to reflect on how he could have been in an accident that evening. Mr Green was convicted and given a community corrections order for 2 years, a fine of $800, disqualified from driving for 7 months and a mandatory interlock period of 24 months.
GREGG, Kerri-Anne, a 48 year old from Scone appeared and pled guilty to a charge of drive with low range prescribed concentration of alcohol. The offence occurred on May 3 between 9:58pm and 10pm when Ms Gregg returned a reading of 0.05 when she submitted to a random breath test on Satur Road, Scone. Ms Gregg told police she had consumed one 200ml glass of wine at the Willow Tree Hotel in Scone at approximately 9:15pm and finished the beverage at 9:55pm. Ms Gregg had completed traffic offenders program. No conviction was recorded and Ms Gregg received an 18 month community correction order.
HANCKEL, Jack Darryl, a 23 year old from Merriwa appeared and pled guilty on a charge of drive with middle range prescribed concentration of alcohol. The offence occurred at 10:50pm on Friday, September 14 when Mr Hanckel submitted to a random breath test on Vennacher Street, Merriwa and returned a reading of 0.089. Mr Hanckel told police he has consumed four schooners of Iron Jack larger, two nips of Jameson’s Whiskey between 7pm and approximately 10:40pm. The Magistrate noted that it was not the manner of his driving which brought him to the attention of police. Magistrate Soars further noted she is the coroner for this region and regularly sees the deaths of people on the roads. Magistrate Soars noted most people in regional areas have a strong need for a licence, but said she had to weight the seriousness of the offence. Mr Hanckel was convicted, disqualified from driving for six months and fined $700. Magistrate Soars cautioned that drink driving offences are serious and the community need to understand these offences won’t be tolerated.
HAYES, Aaron James, a 31 year old from Jindalee in Queensland failed to appear on a charge of drive with low range prescribed concentration of alcohol. The offence occurred at approximately 8:45pm on September 14 when Mr Hayes returned a reading of 0.063 at Liverpool Street, Scone. Mr Hayes was convicted in his absence, fined $500 and disqualified from driving for six months.
HERRALD, Michelle Clare, a 48 year old from Gunnedah had a charge of possess prohibited drug and resident three months not obtain NSW licence. The alleged offence of possess prohibited drug occurred at 2pm on January 1 in Scone, when police claim to have found 4.2 grams of methylamphetamine. The matter was adjourned to Tamworth local court on November 5.
HINDE, Sophie, a 22 year old from Scone pled guilty to a charge of drive with low range prescribed concentration of alcohol. The offence occurred on September 15 at approximately 0:08am when Ms Hinde was stopped for a breath test on Main Street, Scone and returned a reading of 0.079. Ms Hinde told police she had consumed four alcoholic drinks between 7pm and 11:30pm. The drinks were vodka lemon and lime at the Belmore Hotel in Scone. Ms Hinde was found guilty and given a conditional release order for 18 months.
JONES, Ryan Alexander, a 20 year old from Aberdeen pled not guilty to a charge of common assault. The matter was set down for hearing on December 21.
JOHNSON, Timothy Ansel Bruce, a 36 year old from Scone appeared on a charge of driver use mobile phone when not permitted. The alleged offence occurred on May 30 on Pittwater Road, Brookvale. The defendant is to complete the traffic offender program. The matter was set down for mention on December 20 for traffic offenders program certificate and a conditional release order for 12 months.
KANAPATHILPILLAI, Paramseshwaran, a 55 year old from Scone pled guilty to a charge of drive with middle range prescribed concentration of alcohol. The offence occurred between 11:05pm and 11:10pm on July 12 when Mr Kanapathilpillai returned a reading of 0.132 at St Aubin’s Street, Scone. He told police he had consumed approximately three glasses of wine, his first at 4pm and the last at approximately 7pm. Mr Kanapathilpillai was convicted, fined $650 and disqualified from driving for nine months.
KERR, Karmen Jade, a 28 year old from Aberdeen failed to appear on a charge of drive motor vehicle while licence suspended. In her absence the court found her guilty and issued a fine of $350 and a disqualification period of six months.
MACAULAY, Cassey Jonell, a 36 year old from Singleton had charges of handle explosive/precursor without authorising licence and negligently handle explosives to endanger person’s life. The alleged offences occurred between 10:35am and 12:49pm on February 14 in Singleton when the accused handled explosives with a number of detonators and dyno emolite explosives without a licence and not stored properly. The matter was adjourned until November 22.
MARHEINE, Nicole, a 44 year old from Denman pled not guilty to a charge of destroy/damage property in company <=$2,000. The matter was adjourned until December 21.
MANNING, Clinton John, a 38 year old from Scone had charges of drive recklessly/furiously or speed/manner dangerous second offence and possess or use a prohibited weapon without permit. The alleged offences occurred at approximately 8pm on May18 on Kelly Street, Scone. The matter was set down for mention on November 5 in Muswellbrook, with Magistrate Soars stating if Mr Manning pleads not guilty the matter is to be returned to Scone court.
MCDONALD, Luke Oliver, a 25 year old from Rouchel appealed a decision of the Roads and Maritime Services. Mr McDonald had completed the traffic offenders program. His application was dismissed, but the suspension was varied to seven days commencing on Thursday, October 18.
MILES, Martin Thomas, a 27 year old from Coopernook appeared for hearing on two charges of unlawfully obtained goods in personal custody and one charge of unlawfully obtained goods in/on property after a set of NSW number plates were located in the rear footwell of his car in Scone on May 3. The two charges of unlawfully obtained goods in personal custody were withdrawn and the hearing continued for the goods in/on premises. The prosecution failed to prove Mr Miles had sufficient knowledge that the plates were there after there had been several people use or travel within the vehicle, he was found not guilty and the charge was dismissed.
OVERELL, Michelle, a 52 year old from Joyner, Queensland pled guilty to a charge of drive with middle range prescribed concentration of alcohol. The offence occurred on July 4 at approximately 11:55pm on the New England Highway at Dundee, when Ms Overell returned a reading of 0.089. She was convicted, fined $650 and disqualified from driving for six months.
PARTRIDGE, Timothy Robert, a 21 year old from Gunnedah failed to appear on charges of not keep firearm safely-not prohibited firearm/pistol, possess unregistered firearm-not prohibited firearm/pistol and possess ammunition without holding licence/permit/authority. The offences are alleged to have occurred on April 11, 2017 at Ellertson. The matter was adjourned until November 22.
PEARCE, Jade Elizabeth, a 25 year old from Carrowbrook appeared on charges of enter enclosed land not prescribed premises without lawful excuse, holder of category A or B licence not have approved storage, drive with passenger in/on part of vehicle not enclosed and destroy or damage property. The matter was adjourned until December 20.
POLITIS, Nicholas, a 19 year old from Scone had a charge of assault occasioning actual bodily harm. The matter was adjourned until Dec 20.
POWER, Zoe from Scone was in court regarding personal violence applications from Kassandra Box and Scott Marshall, the matter was set for hearing on December 21.
RAWLINGS, Zac, a 22 year old from Merriwa, appeared and pled guilty to charges of destroy or damage property, licence expired less than two years before, use unregistered registerable class A motor vehicle on road and use uninsured motor vehicle. Mr Rawlings pled not guilty to two counts of common assault. The matter was adjourned for hearing on December 21.
RIDE, Hannah Joan, a 22 year old from Fletcher failed to appear on a charge of drive vehicle, illicit drug present in blood. The alleged offence occurred at approximately 3am on June 8 on Liverpool Street, Scone, when she returned a positive reading to methylamphetamine. The matter was adjourned until November 22.
SAUNDERS, Clinton John, a 22 year old from Scone had two charges of assault occasioning actual bodily harm, one charge of armed without commit indictable offence and two counts of stalk/intimidate intend fear physical harm etc The matters were adjourned until November 22.
SIEVERS, Natalie Clare, a 32 year old from Heatherbrae, had a matter of breach of bond – not comply with supervision. Ms Sievers asked for the opportunity to re-engage with the program and the matter was adjourned until November 22.
THRELFALL, Luke, a 36 year olf from Muswellbrook appeared in custody for a hearing of assault occasioning actual bodily harm and contravene a prohibition/restriction specified in an order from an incident in Merriwa on August 24. Mr Threlfall’s hearing was adjourned to Tamworth on December 7 and he was released on bail to reside in Muswellbrook.
WALTERS, Mark Joseph, a 33 year old from Parkville appeared on charges of handle explosive/precursor without authorizing licence and negligently handle explosives to endanger persons life. The matter was adjourned until November 22.
WATTS, Alan, a 34 year old from Muswellbrook had charges of drive vehicle, illicit drug present in blood. The alleged offence occurred at approximately 6:14pm on June 6 on Waverley Street, Scone, when he returned a positive result for methylamphetamine. Mr Watts was given a conditional release order for 18 months.
WILLIAMS, Joseph, a 30 year old from Hobart had breached bond conditions but had re-engaged and it was recommended no further action be taken for the breaches. No further action was taken.
WRIGHT, David John, a 46 year old from Scone pled not guilty to a charge of break and enter house etc steal value <=$60,000, but did not enter a plea for use unregistered registerable class A motor vehicle on road or use uninsured motor vehicle. The matter was adjourned until December 20 when a plea must be entered for all matters.
WYNTER, Martin Alan, a 36 year old from Largs failed to appear on charges of possess prohibited drug and drive vehicle, illicit drug present in blood. The matter was adjourned until November 22.
