Scone Court Report: June 2018 – Part 1

THE Scone Court Report will be published in two sections this week. The second section will be published on Tuesday afternoon, once the files for the hearings are available. The following matters were heard on Thursday:

AGNEW, Tristan Lee, a 37 year old from Rutherford had charges including custody of a knife in a public place and goods in personal custody suspected stolen being a Commonwealth Mastercard in another person’s name. The incidents occurred on the New England Highway at Scone at approximately 12am on May 3. Another matter relating to driving a motor vehicle during disqualification in Murrurundi at approximately 10:30am on April 30. Mr Agnew failed to appear and a warrant was issued for his arrest.

ALLGOOD, David, a 28 year old from Singleton presented in custody on a charge of breaching bail conditions. Mr Allgood said he had travelled to Belmont Hospital to see his grandfather who was terminally ill. The matter was adjourned to Singleton on August 16.

AUSTRALIA’S Cheapest Car Sales from Belmore challenged a decision by the Roads and Maritime Services on the charge of cause or permit use of unregistered vehicle on the road. The trade plate used on the vehicle was not in accordance with the placement guidelines. The matter was dealt with by issuing a bond to be of good behavior for 12 months.

BARNES, Adam John, a 45 year old from Narromine had charges of custody of a knife in a public place, drive while licence cancelled, destroy or damage property and three charges of possess prohibited drug. On September 28 police had observed a car parked in the rest area on the Golden Highway at Cassilis at 10pm. When they approached the vehicle they noted a strong odour of cannabis and conducted a search of the car. During the search they found cannabis, MS Contin in 5mg and 10mg and Endone 5mg tablets. The mother of Mr Barnes gave testimony that the prescription medications belonged to her and she had inadvertently left them in his car after she had been on a shopping trip. Magistrate Soars gave Mr Barnes a fine of $300 for being in custody of a knife, $300 for possess cannabis and a bond to be of good behavior for 12 months. Magistrate Soars further noted that breaching the bond could result in goal.

CHAN, Yew Seng, a 22 year old from Aberdeen had a charge of negligent driving, no death or grievous bodily harm and sought permission to have the matter heard in Tamworth with a Cantonese interpreter. The matter was referred to Tamworth on July 2.

COLLIE, Georgia, a 22 year old from Aberdeen had a charge of drive with low range prescribed concentration of alcohol from an incident in Scone on February 17 returning a reading of 0.064. She was found guilty with no conviction recorded and given a bond to be of good behavior for 18 months.

COOPER, Guy Gregory, a 22 year old from Kilaben Bay had a charge of drive with high range prescribed concentration of alcohol, the matter was adjourned to July 19 to enable him to complete the traffic offenders program.

COX, Dalton Henry, a 20 year old from Scone pled guilty to charges of behave in offensive manner in/near public place/school, aggravated deposit of litter, break bottle/glass/syringe in public place, drive vehicle illicit drug present in blood and three counts of dishonestly obtain property by deception. The matters were adjourned until July 19.

CROFT, Paul Aaron, a 42 from Carey Bay had a charge of drive licence suspended. Mr Croft will complete the Traffic Offenders Program and the matter was adjourned until August 21.

DARCY, David John, a 46 year old from Murrurundi had a charge of drive across dividing lines to do a U-turn on December 29 on the New England Highway. Mr Darcy was given a section 10 bond to be of good behaviour for 12 months.

DAVIDSON, Christopher Gordon, a 33 year old from Blacksmiths pled guilty to a charge of drive vehicle illicit drug present in blood. The incident occurred at approximately 9:20pm on February 1 in South Kempsey when Mr Davidson returned a positive result for methylamphetamine. Mr Davidson was given a good behavior bond for 18 months.

DUDDY, Robert Norman, a 64 year old from Willow Tree pled guilty to charges of class A vehicle number plate obscured/defaced and drive/tow vehicle with unsecured load. He was fined $439 for the unsecured load and a 12 month good behavior bond for the number plate being obscured.

DUGGAN, Peter John, a 45 year old from Merriwa had a charge of drive with low range prescribed concentration of alcohol from an incident in Merriwa on December 8 returning a reading of 0.055. He has completed the traffic offenders program and no conviction has been recorded, a bond to be of good behavior for 18 months was applied.

FOGG, Krystle-Lee Elizabeth, a 35 year old from Cessnock failed to appear on a charge of goods in personal custody suspected being stolen. On March 3, at 3:10am police had noticed a vehicle outside a known drug location on Scott and Burrell Street Scone and approached and then searched the vehicle. Police found a small cream coloured purse containing $5,060. Ms Fogg was convicted in her absence, fined $500 and the money found by police is to be forfeited.

GEE, Wade Allan, had charges of novice driver drive with novice range prescribed concentration of alcohol and not comply P2 licence condition not display P plates. Mr Gee will complete the traffic offenders program and the matter was adjourned until July 19.

HAYDON, Peter Bernard, a 63 year old from Blandford pled guilty to a charge of holder of Category A or B licence not have approved storage. The matter was adjourned until July 19.

HEYCOX, Patrick William, a 45 year old from Cassilis had a charge of drive with low range prescribed concentration of alcohol. Mr Heycox will complete the traffic offenders program and the matter was adjourned until July 19.

HOLA’AFOLAU, Fine Lemeki, a 20 year old from Scone had a charge of special category driver drive with special range prescribed concentration of alcohol when a blood alcohol reading of 0.025 was returned on March 31 in Scone. No conviction was recorded and a good behavior bond of 18 months was applied.

IONGI, Sione Ofa-He-Mooni, a 23 year old from Scone had a charge of assault occasioning actual bodily harm. The matter was adjourned until July 19.

ISAAKO, Galu, a 20 year old from Muswellbrook appeared in custody for contravening an apprehended violence order. The matter was adjourned to Muswellbrook court on June 26.

KING, Cassidy Glen, a 23 year old from San Remo pled not guilty to a charge of drive motor vehicle while licence suspended. The matter was set for hearing on August 24.

KIRK, Anthony Phillip, a 31 year old from Muswellbrook had two counts of shoplifting from Scone post Office on March 29. The matter was referred to Tamworth court on September 5.

LUNDIE, Maxwell Charles, a 17 year old from Merriwa had a charge of P2 driver exceed speed by more than 10km on Bunnan Road, Bunnan on November 7. Mr Lundie was found guilty with no conviction and a bond to be of good behavior for 12 months was applied.

MCARDLE, Jamie-Lee, a 23 year old from Scone had a charge of possess prohibited drug being 12.1 grams of cannabis leaf. Police had attended the Golden Fleece Hotel in Scone and noted a strong smell of cannabis from the room of the accused and observed a small plastic reusable bag of green vegetable matter on the side of the bed. Mr McArdle was found guilty and given a 12 month good behavior bond.

MCKINNON, Serena Valerie, a 43 year old from Merriwa had a charge of drive while licence cancelled. The matter was adjourned to July 19.

MILLINGTON, Brian, a 52 year old from Scone had a charge of drive vehicle, illicit drug present in blood. Mr Millington returned a positive test to methylamphetamine and delta-9-tetrahydrocannabinol on Kingdon Street, Scone on July 16. He was fined $300 and disqualified from driving for 6 months.

MORTIMER, Bryce Dean, a 32 year old from Scone pled guilty to a charge of drive with low range concentration of alcohol when he returned a reading of 0.068 on April 10 on Satur Road, Scone. He was given a good behavior bond for 18 months.

MUNRO, Andrew Gary, a 41 year old from Wallarah pled guilty to two charges of not keep firearm safely-not prohibited firearm/weapon. He was fined $200 for not keeping ammunition safely and $300 for not keeping two rifles safely. Mr Munro will oppose the destruction of the firearms.

NICKERSON, Dean Joseph, a 28 year old from Singleton appeared in custody after an arrest warrant was executed for failing to appear in relation to charges of possession of unlawfully obtained goods, unlicenced for class and resist/hinder police or incite another to assault/resist or hinder police. Mr Nickerson was given bail to appear in Cessnock court on July 4 with the condition that he is not to occupy the driver’s seat of any vehicle.

OVERTON, Tammie, a 34 year old from Scone had a charge of drive with middle range concentration of alcohol. Ms Overton is attending the Traffic Offenders Program and the matter was adjourned until August 23.

PRINGLE, Damon, a 45 year old from Scone had three charges of possess prohibited drug and two counts of goods suspected stolen. Representation by a third party was made to Muswellbrook court to indicate he could not attend the proceedings. The matter was adjourned until July 19 where he must attend or a warrant will be issued.

JOHNSON, Katrina, a 31 year old from Scone appealed a decision by the Roads and Maritime Services. The application was dismissed but Magistrate Soars imposed a suspension period of seven days commencing on June 22.

ROWE, Jason Noel, a 43 year old from Bunnan had charges of common assault, damage property by fire/explosive, stalk/intimidate intend fear physical harm and destroy or damage property. In custody and not present in court. The matters were adjourned to Tamworth on June 25.

SULLIVAN, Victoria Anne, a 33 year old from Scone had charges of drive recklessly/furiously or speed/manner dangerous, never licenced person drive vehicle on road and drive with high range prescribed concentration of alcohol. A plea of guilty was entered and the matter was set for sentence on August 23 to enable a pre-sentence report to be made.

TEIXEIRA, Joshua, a 22 year old from Marmong Point had a charge of drive motor vehicle while licence suspended the matter was adjourned to July 19 when a plea must be entered.

THONE, Michael, a 25 year old from Gungal failed to appear on the revocation of a Community Service Order where he failed to comply to the order. The order was in reference to four charges of drive motor vehicle while licence suspended. A warrant was been issued for his arrest.

WRIGHT, Leonie, a 46 year old from Scone had three counts of drive vehicle, illicit drug present in blood. Fines of $200, $300 and $400 were given for the offences respectively and a disqualification for 6 months was applied to each of the offences.
